Acceptable Usage Policy (AUP)
By ordering and/or purchasing a service from TotalShells you agree to and are legally bound to the following:
Indemnification
You hereby agree to indemnify TotalShells from any and all monetary and non-monetary damages.
Modification
TotalShells reserves the right to modify this TOS/AUP without prior notification at any time. It is in your best interest to check it often.
Currency All dollar amounts used are quoted in the form of United States Dollars ($, USD).
Payment
All payments must be made in good faith and originate from a source owned by the account holder. You agree not to initiate a purchase from a card or account you do not own and/or have direct access to or in a manner that is in violation with U.S. law, your card or account (eg. PayPal) acceptable use policies, or the law of any country or territory you are a resident of. Accounts 5 (five) days or more overdue may be suspended until payment is received. After 5 days and before 14 days of an account becoming overdue, TotalShells may at their discretion charge a $5.00 USD administration fee to re-activate the account. Accounts 14 (fourteen) days overdue will be purged.
Refunds
All sales are final. After an account has become "active" (e.g, account has been added and user has logged in), NO REFUNDS are given. No refunds given to suspended accounts which are in violation of this AUP.

Account Sharing/Reselling TotalShells Services
TotalShells does not, under any circumstances, allow normal user accounts to be resold to other users. Users found doing this will have their account suspended. Anyone who would like to start a reseller partnership with TotalShells can e-mail admin@TotalShells.com for more information.
TotalShells does not encourage users to share their accounts, but does not disallow it. TotalShells will not be responsible for anything that happens to your account, since you are the sole owner of the account. If you choose to share your password, anything that happens to your account is your responsibility. It is also your responsibility to keep your password safe and secure.
Use Restrictions
The following types of processes (or any related processes) may not be run/hosted on any TotalShells server without explicit permission:
* Emech Bots (or Eggdrops with multiple server scripts)
* XDCC Bots or XDCC Bot Hubs
* Seti @ Home Clients
* OpenNAP Clients/Servers
* Any server hosting anything illegal, such as "Litmus" bots
Users are forbidden from using their accounts on the TotalShells or affiliate networks for any activity that may be considered illegal. This is at the discretion of either TotalShells and/or law enforcement. Addition programs, such as "Root Kits" or other programs that try to break the security of our server and gain "super-user" privileges or try to destroy data are also forbidden. Programs such as "Flooders" or "floodnets" which try to utilize TotalShells's IP addresses in an "attack" on an IRC server or other host are forbidden. Accounts and services may only be used as described by this site (http://www.TotalShells.com) at the time of account activation or this site and the Acceptable Use Policy / Terms of Agreement as it currently resides, which ever is more restrictive. Accounts found running these types of programs will be suspended immediately without prior notification, at the discretion of the admin.
No Privacy
We reserve the right to view, copy, modify, and/or distribute any file on, or being transferred across our network or a network leased by TotalShells as necessary for security and/or government compliance purposes.
Bandwidth Usage
Bandwidth on all TotalShells accounts is unmetered but anyone using b/w heavy applications may be asked to move their shell to a more appropriate TotalShells Hosting Solution.
CPU Usage
No process or user may utilize an excessive amount of CPU usage for more than 5 minutes. Processes using more than half (50%) of the total CPU power for more than five (5) minutes will be killed, at the discretion of the admin.
RAM Usage
Processes utilizing more than a necessary amount of "Random Access Memory" may be killed, at the discretion of the admin.
Processes
Accounts running more than the allotted amount of "Background" processes (processes which no longer receive active input from the user, such as: Servers, Services Daemons, Bots, detached BitchX sessions) may be suspended or the extra processes killed, at the discretion of the admin.
The "screen" process will not count towards the process limit, but the process being run by screen does (no matter what it is).
BNC Usage
Rules for running a BNC (any bnc):
* No Reselling BNC Accounts (email admin@totalshells.com about a reseller partnership)
* Only TWO CONNECTIONS per NETWORK - one if the Network's rules are more restrictive. Any account found to be abusing a certain Network and getting TotalShells IPs banned with be dealt with accordingly.
* No Excessive BNC Sharing (this means, you can't let 100 friends use your BNC - have them buy their own accounts, and you can get credit)
IP Usage
Accounts which have not paid for personal IP addresses are not permitted to run personal programs (such as bots, etc) on common ports which would normally be reserved for paying customers (e.g, IRC ports), nor may bind to system program ports. Any processes found doing this will be killed, at the discretion of the admin.
